Welcome to Monnele.

These Terms of Service ("Terms") govern your access to and use of monnele.com, including any content, functionality, customer account features, and purchases offered through the website (collectively, the "Services").

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and acknowledge our Privacy Policy, Shipping Policy, Refund and Return Policy, Cookie Policy, and any other policies or notices made available before purchase. If you do not agree, do not use the Services.

Our store is hosted by Shopify, which provides the ecommerce infrastructure used to operate the Services. Unless otherwise stated at checkout, the seller of products purchased through this website is Monnele, not Shopify.


1. ELIGIBILITY AND CUSTOMER ACCOUNTS

You must be at least the age of majority in your state of residence and legally able to enter into a binding contract to make a purchase. If you allow a minor to use the Services under your supervision, you are responsible for that use to the extent permitted by law.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You may not sell, rent, transfer, or assign your account to another person. Notify us promptly at support@monnele.com if you suspect unauthorized access.

We may suspend or restrict an account when we reasonably believe it is connected to fraud, abuse, a security threat, or a material violation of these Terms. We will not use this provision to restrict a customer's exercise of a lawful consumer right.


2. PRODUCTS AND PRODUCT INFORMATION

Monnele offers apparel, accessories, and related products. We make reasonable efforts to display product descriptions, images, colors, measurements, sizes, materials, availability, and prices accurately.

Actual colors may vary slightly because of lighting, photography, screen settings, or ordinary manufacturing variations. Measurements may also vary within a reasonable manufacturing tolerance. These statements do not excuse a product that is defective, materially different from its description, or otherwise covered by applicable consumer-protection or warranty law.

Size guides are provided for general guidance. Fit can vary by product, design, material, and individual preference. Customers should review the size information displayed on the relevant product page before ordering.

We may update product information, discontinue products, or limit quantities at any time. Changes do not retroactively alter an order that we have already accepted, except when necessary to correct an error and permitted by law.

Products are sold for personal use. You may not purchase products for unauthorized commercial resale, redistribution, or export.


3. ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the products in your cart. An automated order-confirmation email confirms that we received your order but does not necessarily mean that the order has been accepted.

We accept an order when we send a shipping confirmation or otherwise expressly confirm that the order has been processed. We reserve the right, before acceptance, to reject, cancel, or limit an order for legitimate reasons, including:

  • product unavailability;
  • an obvious pricing or product-information error;
  • payment authorization failure;
  • suspected fraud, abuse, unauthorized resale, or unlawful activity;
  • delivery restrictions; or
  • circumstances that make fulfillment impracticable.

If we cancel an order after payment has been collected, we will issue a full refund for the canceled items and any associated amount that must be refunded under applicable law.

Once an order enters processing or has been handed to the carrier, cancellation or modification cannot be guaranteed. Review our Refund and Return Policy for the options available after delivery.


4. PRICES, DISCOUNTS, TAXES, AND PAYMENT

Prices are displayed in U.S. dollars unless otherwise stated. The price charged will be the price shown at checkout when the order is submitted, subject to correction of an obvious error before order acceptance.

Applicable sales tax and other legally required charges may be calculated and collected at checkout based on the order and delivery address.

Discounts, bundle offers, promotional codes, and other offers:

  • apply only during the stated promotional period;
  • may be limited to eligible products, customers, or quantities;
  • cannot be combined unless expressly stated;
  • have no cash value; and
  • may be corrected or canceled in cases of error, fraud, or abuse, subject to applicable law.

Payment must be authorized before an order is fulfilled. Payments are processed by Shopify and other payment service providers. Monnele does not store complete payment card numbers.

You represent that you are authorized to use the payment method submitted. We or our payment providers may request additional information, decline a transaction, or cancel an order when reasonably necessary to verify payment, prevent fraud, or comply with law.


5. FREE SHIPPING, DELIVERY, AND RISK OF LOSS

Monnele offers Free Standard Shipping on eligible orders delivered within the United States.

The estimated delivery timeframe for Free Standard Shipping is 6 to 8 business days, unless a different estimate is clearly displayed at checkout. Business days do not include Saturdays, Sundays, or U.S. federal holidays.

Delivery estimates are not guarantees and may be affected by carrier delays, severe weather, address verification, high-volume periods, customs processing when applicable, or other circumstances outside our reasonable control.

We maintain a reasonable basis for shipment timeframes displayed through the Services. If we learn that we cannot ship an order within the timeframe promised at checkout, we will notify you, provide a revised shipment date when available, and give you the option to accept the delay or cancel the unshipped order for a full refund.

Risk of loss or damage passes to you when the order is delivered to the shipping address you provided, except where applicable law provides otherwise.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you discover an error. We will make a reasonable effort to correct the address before shipment, but changes cannot be guaranteed after processing begins.

If an order is returned because of an incorrect or incomplete customer-provided address, repeated failed delivery attempts, or an unjustified refusal, reshipment or refund terms will be governed by our Shipping Policy and Refund and Return Policy.


6. RETURNS, REFUNDS, AND ORDER PROBLEMS

Eligible items may be returned within 30 calendar days after confirmed delivery, subject to the conditions in our Refund and Return Policy.

Please inspect your order promptly. If an item arrives defective, damaged, incorrect, or incomplete, contact support@monnele.com and provide your order information and supporting photographs when requested.

Our Refund and Return Policy explains eligibility, return authorization, shipping responsibility, non-returnable items, refund processing, lost packages, and related procedures. If these Terms conflict with the Refund and Return Policy on a return-specific issue, the Refund and Return Policy will control unless applicable law requires otherwise.

Nothing in these Terms limits any non-waivable warranty, refund, chargeback, or consumer-protection right.


7. ELECTRONIC COMMUNICATIONS

When you use the Services or provide an email address, you consent to receive transactional electronic communications relating to orders, payments, shipping, returns, accounts, security, customer support, and changes to the Services.

Marketing communications are governed by our Privacy Policy. You may unsubscribe from marketing emails using the unsubscribe link included in the message. Unsubscribing from marketing will not stop necessary transactional or service communications.

You are responsible for keeping your contact information current and for retaining copies of communications and policies relevant to your purchase.


8. INTELLECTUAL PROPERTY

The website and its contents, including text, photographs, graphics, logos, icons, illustrations, designs, interfaces, software, and other materials, are owned by Monnele or by our licensors and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, noncommercial shopping purposes in accordance with these Terms.

Except as permitted by law or expressly authorized in writing, you may not reproduce, distribute, publicly display, modify, create derivative works from, sell, license, scrape, or commercially exploit the Services or their content.

Monnele and related brand names, logos, and trade dress may not be used in a manner likely to cause confusion or imply sponsorship or endorsement without authorization.

If you believe content on the Services infringes your intellectual-property rights, contact support@monnele.com with sufficient information for us to evaluate the claim.


9. REVIEWS, FEEDBACK, AND USER CONTENT

You may submit reviews, photographs, feedback, comments, suggestions, and other content ("User Content") where the Services permit.

You retain ownership of your User Content. By submitting it, you grant Monnele a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, translate, publish, display, distribute, and use that content in connection with operating, improving, and marketing Monnele and the Services, subject to applicable privacy and publicity laws.

You represent that you have the rights necessary to submit the User Content and that it does not:

  • infringe intellectual-property, privacy, publicity, or other rights;
  • contain confidential information you are not authorized to disclose;
  • contain unlawful threats, harassment, discrimination, defamation, or malicious code;
  • impersonate another person or misrepresent your experience; or
  • constitute spam, undisclosed paid promotion, or fraudulent content.

We may moderate or remove User Content that violates these Terms, applicable law, platform rules, or the rights and safety of others. We will not remove content solely because it expresses an honest negative opinion, and nothing in these Terms restricts your right to provide an honest review or report concerns to a government agency.

If a review or endorsement is provided in exchange for a discount, free product, payment, or another material benefit, that relationship must be clearly disclosed.


10. THIRD-PARTY TOOLS, LINKS, AND SERVICES

The Services may contain links to, or integrations and tools provided by, third parties such as Shopify, payment providers, social networks, review platforms, analytics providers, advertising platforms, and carriers.

Third-party services may be governed by separate terms and privacy policies. We do not control independent third-party websites and are not responsible for their content or practices. This does not eliminate any responsibility Monnele has under applicable law for service providers acting on our behalf or for obligations arising from your purchase from Monnele.

Links are provided for convenience and do not necessarily constitute endorsement.


11. SHOPIFY

The Services are hosted by Shopify. Shopify provides the ecommerce infrastructure that allows us to offer products and process transactions.

Unless Shopify is expressly identified as the seller for a particular transaction, Shopify is not the seller, manufacturer, or distributor of the products offered by Monnele. Product quality, fulfillment, customer support, returns, and refunds are the responsibility of Monnele, subject to the roles of our suppliers, carriers, payment providers, and other partners.

Shopify may process personal information and provide security, analytics, personalization, advertising, fraud-prevention, payment, and other services as described in our Privacy Policy and Shopify's own policies.


12. PRIVACY

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy. By using the Services, you acknowledge that you have had an opportunity to review that policy.

Depending on your location, you may have rights regarding access, correction, deletion, targeted advertising, and the sale or sharing of personal information. Instructions for exercising applicable rights appear in our Privacy Policy and through the Your Privacy Choices link available on our website.


13. PROHIBITED USES

You may not use the Services to:

  • violate any applicable law or the rights of another person;
  • commit or facilitate fraud, theft, unauthorized transactions, or deceptive conduct;
  • upload or transmit malware, viruses, or harmful code;
  • gain or attempt to gain unauthorized access to accounts, systems, or data;
  • interfere with the operation, security, or availability of the Services;
  • collect personal information about others without authorization;
  • send spam or unauthorized commercial communications;
  • impersonate another person or falsely imply an affiliation;
  • circumvent purchase limits, security controls, access restrictions, or privacy choices;
  • use scraping, crawling, bots, or automated systems in a manner that imposes an unreasonable burden, bypasses technical controls, or extracts content for unauthorized commercial use; or
  • use the Services in a way that damages Monnele, Shopify, our customers, or another person.

We may take reasonable technical or legal measures to prevent prohibited conduct.


14. AUTOMATED AGENTS AND ARTIFICIAL INTELLIGENCE

Automated access by bots, agents, artificial-intelligence systems, or similar software is permitted only when it complies with these Terms, applicable law, and our technical instructions.

Automated systems may not evade access controls, misrepresent their identity when identification is technically requested, overload the Services, make unauthorized purchases, or copy content for unauthorized commercial exploitation.

We may limit or block automated access that threatens security, availability, intellectual property, or customer privacy.


15. ERRORS AND CORRECTIONS

Occasionally, the Services may contain typographical errors, inaccurate information, or omissions relating to descriptions, pricing, promotions, availability, images, sizes, or delivery estimates.

We may correct errors and update information. If an error materially affects an order you submitted, we will notify you when reasonably possible and, where appropriate, allow you to confirm the corrected order or cancel for a full refund.

We will not use this section to make a material adverse change to an accepted order without providing a remedy required by law.


16. WEBSITE AVAILABILITY AND DISCLAIMER

We use reasonable efforts to operate the Services reliably, but the website, account tools, and digital content may occasionally be interrupted, delayed, unavailable, or contain technical errors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND DIGITAL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR COMPATIBILITY WITH EVERY DEVICE OR BROWSER.

This website disclaimer does not disclaim or limit warranties or remedies that apply to products under federal or state law. Any express product warranty, if offered, will be provided separately and made available before purchase as required by law.

Some states do not permit certain warranty exclusions, so some of the language above may not apply to you.


17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONNELE AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE DIGITAL SERVICES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONNELE'S TOTAL LIABILITY ARISING FROM A PRODUCT ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, gross negligence, personal injury caused by a defective product, violation of non-waivable consumer rights, or any other liability that applicable law prohibits us from limiting.

Some states do not allow the exclusion or limitation of certain damages. In those states, the limitations apply only to the extent permitted by law.


18. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Monnele harmless from third-party claims, damages, and reasonable costs arising directly from your unlawful misuse of the Services, your intentional violation of these Terms, or User Content that infringes another person's rights.

This obligation does not apply to claims caused by Monnele's own conduct or to the extent prohibited by consumer-protection law. We may control the defense of a covered claim, and you agree to provide reasonable cooperation.


19. EVENTS OUTSIDE REASONABLE CONTROL

Neither party will be responsible for a delay or failure caused by events outside its reasonable control, such as severe weather, natural disasters, widespread carrier interruptions, labor disputes, government actions, public-health emergencies, war, civil unrest, or major infrastructure failures.

This section does not eliminate Monnele's obligation to provide delay notices, cancellation options, or refunds for unshipped orders when required by law.


20. SUSPENSION AND TERMINATION

We may suspend, limit, or terminate access to the Services when we reasonably believe a user has materially violated these Terms, engaged in fraud or abuse, or created a security or legal risk.

Where reasonable, we will provide notice. Immediate action may be taken when necessary to protect customers, accounts, systems, legal rights, or the Services.

Termination does not affect rights and obligations relating to an accepted order or provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, dispute terms, and privacy obligations.


21. GOVERNING LAW AND DISPUTES

Before filing a formal claim, you and Monnele agree to make a good-faith effort to resolve the dispute informally. Contact us at support@monnele.com and describe the issue and requested resolution. We will make a reasonable effort to respond.

These Terms are governed by the laws of the jurisdiction in which the legal entity operating Monnele is established, without regard to conflict-of-law rules. This choice of law does not deprive a U.S. consumer of any non-waivable protection provided by applicable federal law or the law of the consumer's state of residence.

Any dispute may be brought before a court that has lawful jurisdiction over the parties and the dispute. Nothing in these Terms prevents either party from bringing an eligible claim in small claims court or seeking relief from a government consumer-protection agency.


22. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in law, technology, the Services, or our business practices. The current version will be posted on this page with a revised "Last updated" date.

Changes apply prospectively and do not retroactively alter the material terms of an order already accepted, unless required by law or agreed by the customer. If a change materially affects your rights, we will provide additional notice where required.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms for future use of the Services, to the extent permitted by law.


23. ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent.

Monnele may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the business, provided that the assignment does not reduce any non-waivable consumer rights.


24. SEVERABILITY; WAIVER; ENTIRE AGREEMENT

If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

A failure or delay in enforcing a provision is not a waiver of the right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement between you and Monnele concerning the Services and purchases made through the website, except for any additional terms expressly presented and accepted for a particular promotion, product, or transaction.
